On Monday, July 22, a complaint was filed by the Borivali railway police against eight ticket checkers (TC) for allegedly assaulting and abusing a passenger. This incident involved 27-year-old Zuber Ahmad, who lives in Palghar.
Ahmad is an employee of a private enterprise and was travelling between Andheri and Virar on Monday, July 22, at around 2:00 pm. He was reportedly travelling without a ticket. Later, a ticket checker (TC) arrived in the compartment just before Borivali Station and began checking tickets.
On finding Ahmad without a ticket, the TC took him to the TC's office on platform no. 10 at Borivali station. Ahmad and the TC got into an argument. According to the police, Ahmad was allegedly subjected to blows and kicks by the TC and five to six more TCs.
After this, Ahmad went to the Borivali railway police station to file a complaint. However, the railway administration has denied the allegation of physical attack and harassment. Railway sources have suggested a different account of the incident.
As per railway sources, the passenger was rude and refused to pay a fine. However, when he was taken to the Borivali railway police station by the TC, the passenger paid the fine and left. Then, two to three hours later, the traveller returned to the Borivali railway station to file the complaint.
At the police station, Ahmad filed an assault complaint against six to seven unidentified ticket checkers. The police said that they would review the TC room's security footage to confirm the facts.
The complaint has been filed under several sections of the Bharatiya Nyaya Sanhita Act. These counts include: voluntarily hurting an individual - 115(2), wrongfully restraining an individual - 126(2), wrongful confunement - 127(2), unlawful assembly - 189(2), everyone from the unlawful assembly committing offence against a common target - 190, mischief - 324(2), and insulting an individual and breaching peace - 352.
As per sources, there has been an ongoing dispute between Borivali GRP and the ticket checkers. Despite passengers' rudeness, railway sources claim that Borivali GRP rarely files complaints against them. Reports also suggest that TCs have to wait hours before Borivali police file a complaint against an impolite passenger.
