It is now evident that Uddhav Thackeray whose party chief post is unconstitutional and he is trying to declare the Shinde-Fadnavis government as unconstitutional. Therefore, state BJP Chief Spokesperson Keshav Upadhye has demanded that Uddhav Thackeray should apologise and step down from the post of party chief for cheating Maharashtra by taking advantage of all the Shiv Sainiks who have been loyal to Balasaheb and the unconstitutional post.

Earlier, Thackeray won the party chief unconstitutionally, and later took advantage to become Maharashtra’s Chief Minister. Upadhyay has alleged that Uddhav Thackeray has mocked Balasaheb's desire to make a common Shiv Sainik as Chief Minister with his dubious intentions.

Uddhav Thackeray once proudly said that 'Bala Saheb was naive, I am cunning'. He proved his cunning by conspiring to gain positions. Upadhaye also alleged that Balasaheb was cheated along with ordinary Shiv Sainiks.

According to the order of the Election Commission, the constitution of Shiv Sena created by Balasaheb Thackeray in 1999 was centred on Balasaheb. The post of Shiv Sena working president was given to Uddhav Thackeray when Balasaheb Thackeray was alive. However, after the death of Balasaheb Thackeray, the post of Shiv Sena party chief was created without changing the constitution.
