On Monday, September 13, the Bombay High Court granted a head constable of Thane Police pre-arrest bail who was booked for the rape of his subordinate. 

The bench said that custodial investigation wasn't required since he had followed all the directives by the court. He even submitted his cell phone that contained the objectionable content of the woman.

The police arrested the accused after an FIR was filed against him on May 21. He had filed an anticipatory bail apprehending arrest.

Since January, the woman was allegedly harassed and sexually assaulted multiple times said the prosecutor.

The advocate representing the constable said that his client was falsely accused. Reportedly, he said it was a presumption, and even if one assumes that the allegations are true, the relationship was consensual, and FIR is registered for some different reason.

The Whatsapp chats showed that their relationship was cordial, and the woman was undergoing stress after fighting with her husband.

He added that there were certain discrepancies in the FIR since there was a delay in filing it.

The applicant was directed to appear before the investigating officer and was granted interim protection by the High Court on June 21.

The bench had further said that the constable had provided the cellphone to the investigation officer, and hence custodial interrogation isn't necessary.

A single-judge bench of Justice Prakash D Naik said that the applicant was to be released on bail. He has asked the applicant to co-operate in the investigation.
