Illegal constructions built before December 31, 2015 can be legalised: BMC

The BMC will issue a public advertisement and the owner or the person in possession of the construction will have to file for legalising the construction within a span of six months.

The illegally constructed buildings in Mumbai that have been constructed before December 31, 2015 will be legalised soon. However, the legalisation of these buildings will be conducted under some conditions and also, double development fees will be levied on the construction.

The Urban Development Department of the State Government had issued the Government Resolution (GR) on October 7, 2017 that by charging the illegal constructions and imposing the penalty as per the rules, the illegal constructions can be declared as legal structures.

On the basis of the GR, all the illegal constructions of the buildings constructed before December 31, 2015 have been legalised. The GR has been sent to the Reform Committee for approval.

The illegal construction will be legalised with a double development fee. For which, BMC will issue an advertisement and the owner or the person in possession will have to apply for legalisation within six months.

A BMC official said that on receiving the application, BMC will decide which constructions are to be legalised and which to be not. He said that after the decision from the Reform Committee, the work to legalise illegal constructions before December 31, 2017 will also be undertaken.
