With the retirement of former top cop Sanjay Pandey, the Mumbai Police has issued a fresh circular withdrawing two orders last month passed by him.

The two orders, that currently stand cancelled, pertains to the registration of FIRs of molestation cases and those under the Protection of Children from Sexual Offences (POCSO), Act.

In an official statement issued by the deputy commissioner of police Sanjay Latkar noted that the order was cancelled after seeking permission from newly appointed Mumbai police commissioner Vivek Phansalkar.

The statement further read, “If the police stations receive any complaint in connection with POCSO or molestation, appropriate legal action should be taken as per the provisions of the relevant law. On July 12, 2022, the order was issued with the approval of the Commissioner of Police.”

For those unversed, Pandey on June 17, again revised the order that was amended under POCSO Act recently, which mandated that no FIR for molestation or offences shall be registered without zonal DCP’s permission, after receiving criticism.

Earlier, on June 6, former Mumbai CP issued a circular, which said a First Information Report (FIR) for molestation or under the POCSO Act should be registered only upon a recommendation by an ACP and after receiving permission of the DCP of the zone. The reason then cited for the directive was that many times false cases of such offences are registered due to disputes over property, money.
