Amazon India Approaches Bombay High Court Over the Summons Issued Against Its VP

Amazon India Vice-President, Amit Agarwal was served a summons by the Thane Magistrate Court in Ulhasnagar a few weeks ago. Taking this into account, the e-commerce giant approached the Bombay High Court seeking to quash the magistrate’s order on August 26.

The summons against Agarwal was issued on the basis of a criminal complaint filed by a local lawyer alleging that he did not receive a product ordered on the Amazon India website.

A resident of Ulhasnagar, lawyer Amritpal Singh Khalsa claims that he did not receive an order containing a hard drive valued at ₹3,999 in December 2019. He further said that the local police station refused to file an FIR, which led him to the Magistrate Court. Hearing the case in March 2021, the magistrate instructed Ulhasnagar Police to investigate the matter.

In its plea with the Bombay High Court, Amazon India submits that Agarwal was not handling the day-to-day functioning of the platform, adding that no specific allegation was made against Agarwal by the complainant. 

Amazon India’s lawyers added that Khalsa and Ulhasnagar Police did not follow due process as per the Criminal Procedure Code, thus requesting the complaint to the quashed. The plea will be heard by a bench of Justice Revati Mohite-Dere on the 8th of September.
