The Bombay High Court (HC) has issued notices to the Maharashtra government and the Maharashtra Public Service Commission (MPSC) over a petition seeking inclusion of the "third gender" category in public sector undertaking employment and Socially and Educationally Backward Class (SEBC) as part of their fundamental rights.

It has come to light that amongst those who filed PIL, a transgender identified as Arya, who is 22-year-old, is "qualified for post of police constable" having completed training with Maharashtra police.

According to reports, the PIL was also filed by two organisations - Sampada Grameen Mahila Sanstha (SANGRAM), Muskan Sanstha and a transgender activist named Vinayak alias Veena Kashid (29).

They urged HC to direct the Maharashtra government to include the option of the third gender category in all recruitment and employment provided or controlled by the state.

The petitioners also told HC through their counsel Vijay Hiremath that despite possessing the requisite educational qualifications and training for jobs in the Maharashtra state transport and police departments, they had been unable to secure them.

Meanwhile, a bench led by Justice Amjad Sayed directed the state authorities to file their replies to the plea within three weeks. The court also directed the petitioners to implead the Maharashtra Transgender Welfare Board as a respondent party in the matter.

Later, the HC posted the matter for hearing after four weeks.
