Bombay HC refuses to reduce the sentence of three convicts involved in the 2010 Pune gang-rape case

The bench questioned the cross-examination in the sessions court; however, it upheld the session court's decision and sentenced the trio to life imprisonment.

The Bombay High Court (HC) upheld the life imprisonment of three men involved in the gang-raping of a woman in Pune in 2010.

The court has observed that even though there are convictions in crime against women, the sentences given are not proportionate to the gravity and magnitude of the crime.

HC has denied lessening the sentence of the three convicts of the 2010 Pune gang-rape case. The accused, identified as Ranjeet Gade, Ganesh Kamble, and Subhash Bhosale, were all convicted by Pune sessions court on October 21, 2011.

The division bench of justice Sadhana Jadhav and justice Sarang Kotwal added that when punishment is not given, which is proportionate to the gravity of the offence, it encourages the criminals. The bench further said that it makes justice suffer and weakens the credibility of the system.

The victim had returned from the US in March 2010 while her husband was yet to return to India. On April 1, 2010, she was going to attend a seminar but couldn't find a bus, following which she was offered a ride in a car by two accused.

Assuming it was from a car to be of a call centre heading in the same direction as the seminar venue, she boarded it. She was then driven from one place to another as the duo picked up the third accused.

She was gagged and threatened and was told not to disclose this incident to her mother, or 8-10 persons would rape her. She was then taken to a secluded spot by the trio and was raped by them. She was later dropped near her residence. 

After they were convicted in 2011 an appeal was filed to the HC. 

The defence, among other things, suggested that it was consensual sexual intercourse and that she had consumed alcohol. The defence lawyer also did an improper cross-examination of the victim.

During the trial, the Bombay HC expressed dissatisfaction over sessions court for permitting the defence lawyer to seek graphic details from the victim.
