Recently, a single-judge bench of the  Bombay High Court granted interim protection from arrest to a man.

Mumbra police had booked the man earlier this year for allegedly posting disrespectful content on Facebook against Dr Babasaheb Ambedkar.

On Thursday, September 23, Justice Sandeep K Shinde heard a plea filed by Advocate Tahera Abdul Rashid Qureshi representing the accused, stating that the complainant falsely implicated the man.

According to the police, the accused had sent a post on Facebook which allegedly disrespected Ambedkar. The complainant, a member of Scheduled Caste who holds Dr Amedkar in high esteem, lodged FIR against the man.

The FIR lodged against the accused were offences punishable under the Indian Penal Code (IPC) Sections 295A (Deliberate and malicious acts, intended to outrage religious feelings or any class by insulting its religion or religious beliefs), Section 67 (publishing or transmitting obscene material in electronic form) of the Information Technology Act, and under provisions of Schedule Caste and Scheduled Tribes (Prevention of Atrocities) Act, 1889.

In the court, the lawyer argued that the accused, an RTI activist and whistleblower, was falsely implicated. The post was sent by an unknown person who created a Facebook account in his name.

The court observed that the Senior Inspector of Cyber Cell, Thane, has asked the Investigating officer to submit a report confirming the IP address and other details. 

The report is likely to be submitted within a month, and until then, the accused is released on a bai.

Meanwhile, the court asked the investigation officer to block the Facebook account so that no other objectionable post was circulated.

The court has posted another hearing on October 25.
