Mumbai: SC appointed custodians across local bodies to safeguard living wills

As per the orders of the Supreme Court, proper mechanism has been made available for those who wish to make a living will regarding medical treatment or organ donation. As part of the same, the state government claimed in the High Court on Thursday that 388 officers have been appointed to implement the orders.


The state government made this claim while filing its reply to the Public Interest Litigation filed by Dr. Nikhil Datar. Taking serious notice of Datar's plea, the bench of Chief Justice Devendra Upadhyay and Justice Arif Doctor had mentioned during the previous hearing that this petition is in public interest. Also, orders were given to the BrihanMumbai Municipal Corporation (BMC) along with the Central and State Governments to clarify their position on it. On this, the state government filed an affidavit explaining its stand in the High Court on Thursday. In it, the government said that 388 competent officers have been appointed to implement the Supreme Court order.

Measures are being taken to create awareness about the appointment of these officers. Moreover, the government has also claimed that all the local self-government bodies have been informed through correspondence so that the orders of the Supreme Court to make the system available to the interested parties should be strictly followed.


The Supreme Court had emphasised the right of citizens to die with dignity while passing an order in this regard on January 24 last year. As part of the same, it was also ordered to provide a suitable system or mechanism for execution of living will. Giving proof of this order, Dr. Datar has filed the above Public Interest Litigation. The petition sought an order to the respondents to appoint competent authorities to comply with the orders of the Supreme Court.
