Businessman sentenced to 3 months imprisonment after his 'aggressive' Rottweiler dog attacked 72-yr-old relative

Cyrus Percy Hormusji, the dog owner, was found guilty of violating Sections 289 (negligent conduct with respect to animals) and 337 of the Indian Penal Code by the court (causing hurt by act endangering life or personal safety of others). Hormusji, a resident of Santa Cruz, had argued in court that he was not responsible because the dog was not his. The court did notice, though, that he had brought the dog for treatment. The incident happened 12 years ago when Kersi Irani, the victim, and Hormusji got into an altercation while standing next to the latter's car at Nepean Sea Road in Mumbai regarding a property dispute. The Rottweiler's owner, Cyrus Hormusji, called his relative Kersi Irani on May 30, 2010, and requested for a meeting to discuss a property-related matter that was already in court. Around 5:30 pm the two met at Napean Sea Road.

The Rottweiler and another canine, a Labrador, were barking inside the vehicle. The beloved dog of Hormusji was inside the car and was attempting to exit. The prosecution claims that the accused (Hormusji) unlocked the car door despite being asked not to, allowing the dog to escape and attack the informant (Irani) in front of witnesses. Irani got bit by the dog thrice.

Apart from the investigating officer, the witnesses in the case included the doctor, Irani's son, a veterinarian who examined the dog, and the victim. The court remarked that Rottweiler dogs are renowned "for being robust and possessing forceful bite." It went on to say that the accused's action was negligent rather than purposeful, and as a result, he had committed the crime. Madan Gupta, Hormusji's attorney, submitted a request for sentence suspension. The judge concurred and gave bail to Hormusji.
