Earlier this week, Suraj Godambe, Celebrity hairstylist from Mumbai, who was arrested by the Narcotics Control Bureau (NCB) last month for alleged possession of 11 grams of cocaine was granted bail.
Moreover, on Tuesday, January 12, the bail was granted on furnishing a personal bond of INR 30,000. With regards to granting bail to Godambe, the special judge under the Act HS Satbhai said that the applicant does not have any criminal antecedents. Moreover, in its absence, section 37 of the NDPS Act cannot be invoked and bail cannot be refused. The provision pertains to offences under the law being cognisable and non-bailable. While granting bail, the court has to be satisfied that the applicant is not guilty of the offence and will not commit a similar offence while on bail.
The Celebrity hairstylist was arrested in Andheri back on December 9 along with another accused when NCB the accused him of possessing drugs.
According to reports, Godambe in his bail plea had submitted that he has no criminal antecedents and has been falsely implicated. However, the NCB had opposed the plea stating that the investigation in the case is still in progress. The court said the material investigation in the case was completed on the day of the arrest itself and NCB had not shown why Godambe’s detention in jail was necessary for the ongoing probe. Moreover, the court stated that circumstances including regular attendance before NCB can be imposed to ensure the accused does not flee.
