
The Bombay High Court on Monday reserved its order on the bail application of Mihir Shah, who has been in custody for the past one and a half years in connection with the Worli incident in which he allegedly drove a luxury car under the influence of alcohol and fatally hit a woman riding a two-wheeler last year.
After hearing the government prosecutors' side on Mihir's bail plea, a single bench of Justice Neela Gokhale reserved its decision on the matter. Earlier, public prosecutor Mankunwar Deshmukh claimed that Mihir was not eligible for bail in view of his actions after the accident and opposed his bail plea.
The prosecution told the court that any normal, sensible person would have stopped the car after the accident and helped take the injured to a hospital. However, instead of stopping, Mihir dragged the injured woman for about 1.5 km from the accident spot and then fled from the scene, the prosecutor said.
The prosecution further argued that Mihir comes from an influential, affluent background and that his father is a political leader. Granting him bail at this stage could enable him to pressure witnesses or tamper with evidence, Deshmukh submitted while urging the court to reject his bail plea.
During last week’s hearing, the single-judge bench had also expressed concern about the possibility of Mihir destroying evidence. The court had observed that his bail could be considered only after the key witnesses in the case had recorded their testimony.
In response, senior advocate Ashok Mundargi, appearing for Mihir, contended that the accident was not intentional. He argued that Mihir fled not because he caused the accident deliberately, but out of fear, and possibly because he was under the influence of alcohol at the time.
