The Bombay High Court dismissed the review petition of the Maharashtra Chamber of Industries (MCHI) to seek lift of ban on the new constructions in the city.
The bench of justice Abhay Oke and Chandrakant Bhadang said that the review of this ban cannot be taken up as the BMC has not yet solved the dumping ground issue.
The HC had passed strictures against the BMC for failing to neglect the violation of solid waste management in the city. The court, on March 1, 2016, had also passed an order banning new residential construction projects on private land in the city. The court had excluded the projects of MHADA, SRA, government agencies, hospital, educational institutes etc from this ban order.
Many projects of private builders have got stalled due to the lack of permission from the authorities. This has badly affected the builders as well as customers. This had forced the MCHI to approach the court for review of its ban order.
Meanwhile, MCHI spokesperson told Mumbai Live that future course of action would be decided soon after its petition got dismissed from the court.
