Bombay HC orders Sanjay Raut to be party in Kangana Ranaut's petition

While hearing the petition, a division bench of Justice Shahrukh J Kathawalla and Justice Riyaz I Chagla said that Raut and the BMC officer should get a chance to respond to the allegations levelled by the petitioner.

The Bombay High Court on Tuesday allowed Shiv Sena MP Sanjay Raut to be added as a party to the case filed by Bollywood Actress Kangana Ranaut challenging the demolition of her office in Bandra by the Brihanmumbai Municipal Corporation (BMC). The HC also ordered the concerned BMC officer to become a party to the case. 

On September 9, the BMC had demolished a part of Kangana’s office in Pali Hill citing illegal structure violations. However, the Bombay HC had stayed the demolition process after Kangana filed a petition through her lawyer Rizwan Siddiqui. 

Recently, the actress has amended her petition before the Bombay HC seeking for damages worth ₹2 crores. However, the BMC filed an affidavit in the court opposing Kangana’s plea. Labelling the petition as “abuse of the process of law”, the civic body said that Kangana’s petition should be dismissed with costs.

Now, the Bombay HC ordered Raut and designated officer from BMC H-ward to become a party to the demolition case. While hearing the petition, a division bench of Justice Shahrukh J Kathawalla and Justice Riyaz I Chagla said that Raut and the BMC officer should get a chance to respond to the allegations levelled by the petitioner. 

Kangana submitted a DVD of statements made by Raut and it also pointed out to the reaction - ‘Ukhaad diya’ - by the Shiv Sena MP after the demolition act. As this happened, the court insisted that Raut be made a party to the case. 

Meanwhile, Ranaut through her lawyers Birendra Saraf and Siddiqui has denied the claims made by the civic body that there were no illegal alterations in the premises. The actress filed a rejoinder on Monday saying that BMC abused the ‘process of law’ by initiating demolition work at her office in Bandra. 

The rejoinder stated that Kangana was given only 24 hours to respond to BMC’s notice and her response was rejected in a hurried manner. The matter was to be heard today, on Wednesday, September 23.
