Before the implementation of the code of conduct for the assembly elections, the state government had taken a hasty decision and recommended the names of 7 out of the 12 Legislative Council members to be appointed by the Governor. This includes the names of BJP Mahila Morcha State President Chitra Wagh, State General Secretary Vikrant Patil and Pohradevi priest Babusinh Maharaj Rathore.

Former MP Hemant Patil and spokesperson Dr. Manisha Kayande have been made candidates from the Shinde group's quota, while Pankaj Bhujbal and Idris Naikwadi have been made candidates from the Ajit Pawar group. After getting the approval of Chief Minister Eknath Shinde, the file was sent to the Governor for approval, but the appointment orders were not issued till late night.

Five out of 12 seats are still reserved. Sources said that this decision was taken to keep the hopes of the contenders on these seats alive during the Mahavikas Aghadi government. It was not approved by the then Governor Bhagat Singh Koshyari. The Shinde-Fadnavis government withdrew the previous list of 12 names and now seven new names have been recommended.

The previous government's decision to withdraw the names has been challenged in the High Court and the petition is pending. The court had expressed hope that the appointments which were not made in two and a half years, would be made in a month and the appointments were not stopped, in this regard the Advocate General had also given a statement in the court.

Seven members of the state legislative council, appointed by the governor, were administered the oath of secrecy on Tuesday. Out of the seven new MLCs, the BJP has nominated three, while Eknath Shinde-led Shiv Sena and Deputy Chief Minister Ajit Pawar's NCP have two members each.
