According to a latest development in the demarcation of the wards scuffle, the Supreme Court (SC) on Wednesday, October 19, granted liberty to petitioner to approach the Bombay High Court (HC).

A bench comprising Justices D.Y. Chandrachud and Hima Kolhi asked the petitioner to withdraw the petition filed under Article 32 of the Constitution and approach the High Court inter alia, challenging the constitutional validity of Maharashtra Ordinance No. 7 of 2022 which later became Act 43 of 2022.

In August this year, the Eknath Shinde-led Maharashtra government had reversed the Maha Vikas Aghadi (MVA)’s decision on delimitation of wards last year, which aimed at increasing the number of Brihanmumbai Municipal Corporation (BMC) councillors to 236 from 227.

However, owing to this ongoing brawl between the Shinde and Thackeray faction over the number of BMC councillors, it has come to light that the upcoming civic body polls, which were slated to be held by October, is likely to be postponed further to next year.

The Thackeray group moved the SC against the constitutional validity of the Maharashtra Ordinance No.7 of 2022, which it claims to have 'put the clock back' and the subsequent Act which replaced it. Appearing for the faction, senior advocate Devdutt Kamat pointed out that the apex court had affirmed that the non-completion of the 2021 census would cause no impediment in increasing the number of elected councillors of the BMC.
