Maharashtra: Bombay High Court Directs State, Political Party To File Reply To PIL Against Recent Bandh

The Bombay High Court asked the state and political parties to put in their replies to a PIL filed by former police chief and citizens against what they claimed to be a state-sponsored bandh recently called in Maharashtra.

On Monday, December 20, the Bombay High Court asked the state and political parties to put in their replies to a PIL filed by former police chief and citizens against what they claimed to be a state-sponsored bandh recently called in Maharashtra, reports stated. 

According to accounts, the HC will next hear the matter on February 14. Alleging that the bandh called on October 11 across Maharashtra was "thoughtlessly imposed", the PIL filed by Julio Rebeiro, ex Mumbai police chief amongst others sought an order to ask Shiv Sena, Indian National Congress and Nationalist Congress Party (NCP) that form the MVA government to pay an amount. 

The amount pegged by them stands at INR 3,000 crore as "exemplary damages or compensation" to both the union and state government as well as the citizens through a Bandh Loss Compensation Fund. 

Senior counsel R D Soni for the petitioners was asked by the bench who will be identifying how much and how to be paid. To this, Soni responded that the aim of the PIL is to curate a bandh compensation fund.

Soni, based on narratives, went on to cite a 2004 HC order wherein political parties on whose onus the bandh was called was penalized. This according to Soni was done through the compensation amount to be paid by them.
