
Following a metro construction accident in Mumbai, the Bombay High Court observed that not every accident should automatically lead to the filing of a Public Interest Litigation (PIL). The incident occurred during the construction of Mumbai Metro Line 4 in Mulund, where a heavy concrete parapet reportedly fell from a metro pillar onto vehicles passing below, hitting a rickshaw and a car and causing one death while injuring several others.
After the accident, a lawyer filed a PIL seeking a safety audit of all metro construction projects in Mumbai, a detailed report on the cause of the incident, clarification on why the contractor involved had not been blacklisted, and immediate safety inspections at the site.
During the hearing, the court questioned whether the matter truly involved broader public interest and remarked that every unfortunate accident does not necessarily justify filing a PIL, also noting that the petitioner lives near the construction site.
The court has asked the Mumbai Metropolitan Region Development Authority to submit a status report on the accident, after which it will decide whether the petition should be allowed to proceed.
