Railways liable to pay compensation for passengers’ death or injury while boarding trains: SC

The judgment came in regard to an appeal filed by the federal government which had approached the court against Patna High Court order declaring a compensation of US $5,940 to the wife of a person who died falling out of train due to the rush of passengers in 2002.

On May 9, the Supreme Court ruled that Railways would be liable to pay compensation to passengers if the passenger dies while boarding or de-boarding trains and Railways cannot deny the claim by declaring it as negligence on the part of passengers.

A bench of Justices, A K Goel and R F Nariman ruled that injury or demise during boarding or de-boarding a train will be an ‘untoward incident’ and will entitle the victim to compensation.

High courts across the country had given different verdicts regarding the matter. Some of them held the injury or death during boarding or de-boarding, the victim’s fault and considered it at par with a self-inflicted injury. However, some of them suggested otherwise and directed Railways to pay compensation.

With Supreme Court’s verdict, all the controversies will be put to an end. The court, however, further explained that mere presence of a body on the railway premises would not be considered as a bona fide passenger until relevant documents are not produced.
