Accused of killing a four-month-old girl for wanting a boy gets bail by Bombay HC

The High Court recently granted bail to a woman who was accused of drowning her four-month-old daughter in a water tank in her residential house after being disappointed that she delivered a girl for the second time. The case against the petitioner is based on circumstantial evidence. Moreover, the charges have not been fixed in this case. Hence, the case is likely to take a long time to complete. 


The accused is a woman and has been in jail for one year and eleven months. A single bench headed by Justice Makarand Karnik observed that further detention of the petitioner in such a situation as she has no criminal background would be tantamount to sentencing her before trial. Also, bail was granted to petitioner Sapna Makdoom. Lawyers Satyam Nimbalkar and Omkar Chitale argued on behalf of Sapna.

The petitioner had initially filed a complaint at the Kalachowki police station that the girl had been stolen. On November 30, 2021, a woman came to her house to sell utensils in exchange for old clothes and while she was busy, the woman knocked her unconscious. Also, the petitioner claimed in the police complaint that the woman escaped with her four-month-old daughter. She had also told the police that she was alone in the house at the time of the incident. However, when the police interrogated Sapna thoroughly, she admitted to drowning the girl in the water tank. 


After the birth of her first daughter, she wanted a boy, but when she delivered a girl again, she told the police that she killed her. Sapna was immediately arrested after her confession. She approached the High Court after the sessions court refused to grant bail. Meanwhile, the police argued that the first daughter's life would be in danger if the petitioner was granted bail. Also, her bail was opposed.
