In connection with the allegation of assaulting the officials of the Brihanmumbai Municipal Corporation (BMC) who went to disconnect the illegal electricity and water supply to 25 buildings in Guru Tegh Bahadur Nagar (GTB), High Court suspended BJP MLA Captain R. Tamil Selvan's six-month sentence.


Selvan has challenged the sentence passed by the Sessions Court in the High Court. Selvan had sought an early hearing of the appeal and suspension of the sentence till the disposal of the appeal. A single bench of Justice Sriram Modak accepted Selvan's demand. Accordingly, the court suspended Selvan's sentence pending disposal of his appeal against the sentence and granted him interim bail.


The Sessions Court temporarily suspended Selvan's sentence to allow him to challenge the sentence in the High Court. Selpan demanded that the appeal be heard at the earliest as this period is about to expire. Against this backdrop, the court had adjourned hearing on their petition seeking interim relief. At that time, there is no witness to say that Selvan beat him up. Moreover, no notice was given to the residents before taking action on the concerned constructions by the Municipal Corporation. Therefore, Selvan had gone to the spot to request the residents to give time to file a complaint, the court was told by Selvan.

On the other hand, the public prosecutor opposed Selvan's demand. The court, however, clarified that the appeal would be heard early and ordered that the case and related documents be filed with the office of the High Court Registrar General.


A special court convicted and sentenced Selvan on charges of holding an illegal meeting, rioting, derailing a public servant from his duty and beating him, among other charges.


What is the case?
A protest was held in June 2017 against the order to demolish 25 buildings in the Punjabi Colony at GTB with a total of 1,200 houses. At that time, when the municipal officials went to cut off electricity and water supply to these buildings, Selvan along with other accused led an illegal mob of 1000-1200 people. Also, municipal officials were beaten up.
