The Maharashtra assembly speaker Rahul Narwekar on Wednesday evening, January 10, ruled a crucial verdict on the cross-petitions by Shiv Sena factions seeking disqualification of each other's MLAs. He said: "Shinde faction is the original Shiv Sena and its MLAs cannot be disqualified."

Here are the key points from the verdict:

1) Thackeray does not have any right or power to remove Eknath Shinde and its MLAs. Shiv Sena president doesn't hold the decision making powers but the Rashtriya Karyakarini. 

2) Eknath Shinde was validly appointed as leader of the Shiv Sena.

3) The opinion of Shiv Sena chief Uddhav Thackeray cannot be the opinion of the party.

4) The Uddhav Thackeray camp has not provided any material to back their allegation that Shinde faction was acting in concert with the BJP. 

5) There is no consensus on the constitution submitted by both the parties (two factions of Shiv Sena) to the EC. The two parties have different points of views on leadership structure. The only aspect is the majority in the legislature party.

6) The Speaker based his decisions on the version of the constitution available with the Election Commission.

7) The whip claimed to have been served by Prabhu never reached the Shinde faction members and UBT faction failed to prove so. Disqualification petitions for violating whip issued by UBT for confidence motion on July 4 has also been dismissed, Speaker added.

8) Shiv Sena (UBT) MLA Aaditya Thackeray said that judgement is not acceptable and party will challenge it in SC.

9) It is opportunistic and unfortunate compromise of ethics, said Priyanka Chaturvedi of Shiv Sena (UBT).

10) Speaker has no role to play in tussle between warring political leaders, he stated.
