
The central government has taken a significant step to curb repeat traffic offenders. By making a third amendment to the Central Motor Vehicles Rules, 1989 under the Motor Vehicles Act, 1988, the Central Motor Vehicles (Third Amendment) Rules, 2026 have been implemented, effective from January 20, 2026.
According to the new amendment, from January 1, 2026, drivers who violate traffic rules five or more times within a year will face strict action as habitual offenders. However, violations from the previous year will not be carried forward or counted in the next year.
The government has also emphasised making the e-challan system more transparent and digital. Police officers or authorised state officials can issue challans either directly or electronically. Additionally, automatic challans can be generated through electronic monitoring systems. Physical challans must be delivered within 15 days, while e-challans must reach the concerned person within 3 days.
After receiving a challan, the individual must either pay the fine within 45 days or contest it with necessary documents. If the challan is not contested within the stipulated time, or if the challenge is rejected, the person must either pay the full fine within the next 30 days or deposit 50% of the fine and file an appeal in court. If no action is taken, the challan will be considered accepted, and the full fine must be paid within an additional 15 days.
If the fine remains unpaid even after acceptance, the person will receive daily electronic notifications. Moreover, no applications related to the individual’s driving license or vehicle registration will be processed. In pending cases, a “Not to be Transacted” status will be applied to the vehicle or license. In serious violations, authorities may also seize the vehicle as per court orders.
Meanwhile, pending e-challan cases are being regularly resolved through Regional Transport Offices (RTOs). The Transport Commissioner Office, Mumbai has urged citizens to pay fines on time and follow traffic rules.
