The BrihanMumbai Municipal Corporation (BMC) was recently called to defend itself before the Bombay High Court in a case brought forward by Deepak Shah, a resident of Andheri. Shah is seeking compensation of INR 36 lakh for what he claims was medical negligence and improper treatment that he received at the Bandra-Kurla Complex (BKC) Jumbo Covid centre in Mumbai.


Shah underwent hernia surgery in March-April 2021 and later tested positive for Covid-19. During his stay at the Jumbo Covid centre, Shah developed an infection that required two additional surgeries. The BMC, however, maintains that low immunity caused the infection, a statement that was supported by Shah's doctor.

In response to Shah's allegations, the BMC has asked the court to dismiss the case, claiming that it could set a precedent that would open the floodgates for more people to come forward with similar complaints. The BMC also stated that all treatment at the Jumbo Covid centre was provided free of charge, and denied allegations of negligence by the staff in 2021.


The case was heard by Justice Atul Chandurkar, with senior advocate Anil Sakhare representing the corporation. The judges in the case have given way for Shah to file a rejoinder, and the next hearing will take place in four weeks.
