Bombay HC Makes E-filing Mandatory For "These" Cases

In a recent update, the Bombay High Court (HC) has made e-filing mandatory for petitions regarding criminal and commercial cases.

This development comes two weeks after the court issued a notice making e-filing mandatory for all cases in the Commercial Division, all cases concerning Direct and Indirect Tax, and Non-Commercial Arbitration cases filed at Original Side from January 2, 2023.

Notifications to this effect were released by both the original and appellate sides of the Court.

The categories for which e-filing has been made mandatory from December 9 are as follows:

1. Criminal Writ Petition

2. Applications under Section 482 of the appeal

3. Criminal writ petitions.

4. Criminal leave to appeal

5. Criminal ALP (Leave to file Appeal–Private)

6. Criminal Revision

7. Second Appeal

8. Miscellaneous Civil Application

9. Arbitration Petition

10. Contempt Petition (Civil).

The Court also clarified that filing of new cases would include all kinds of replies to the documents.

It is pertinent to note that the bench has also introduced an online system for requesting urgent listing of cases via a Google form. This is on an experimental basis till a more robust system for e-filing of praecipes (a brief note setting out the urgency) is introduced.
