Mumbai Police Imposes Section 144, Other Restrictions Across City For 15 Days - Details Here

The prohibitory orders, which are issued under Section 37 of Maharashtra Police Act, also includes imposition of Section 144. Section 144 of the Indian Penal Code (IPC) restricts gathering of more than five people in public spaces.

In a significant step, the Mumbai Police has today issued fresh prohibitory orders from November 1 to 15 as there is a possibility and loss of human life and property is a serious threat.

The prohibitory orders, issued under Section 37 of Maharashtra Police Act, also includes imposition of Section 144, which restricts five or more people to gather at a time in public places. 

According to the deputy commissioner of Maharashtra police Sanjay Latkar, this move has been taken after considering inputs from various agencies that there can be disturbance in law-and-order situation in the city owing to festivities and byelections.

Apart from that, no processions will be allowed. Moreover, bursting of firecrackers, use of loudspeakers and music bands in a procession has been restricted. However, wedding ceremonies and funerals are exempted from this order.

Releasing an official statement, the Police department said that the issued preventive orders have been imposed to prevent disturbance of public peace and danger to human life and damage to property and any kind of mischief and prohibiting the movement of more than five thousand persons and illegal assembly.

Here's the detailed order:

1) Prohibition of any assembly of five or more persons

2) Any procession of any person and

3) Any use of loudspeakers, musical instruments, musical bands and bursting of firecrackers in any procession is exempted from the prohibition contained in the order as follows.

(a) All types of marriage ceremonies etc.

(b) Funeral meetings and processions en route to crematoriums / burial grounds. (c) legal meetings of companies, clubs, co-operative societies, other organizations and associations,

(d) Social gatherings, and general affairs of clubs, co-operative societies, other societies and associations their meeting to do.

(e) Assemblies for the purpose of viewing films, plays or programs in or around cinema halls, theaters or any place of public entertainment

(f) Acts of Government and local bodies for carrying out governmental or quasi-governmental functions

(g) gatherings of people in or around courts and offices (h) gatherings in or around schools, colleges and other educational institutions for educational activities,

(i) Meetings for general trade, business and appeal in factories, shops, and establishments. (j) such other assemblies and processions as may be permitted by the Divisional Deputy Commissioner of Police, and his supervising officer.

Even if this order expires after the period mentioned above

(a) Any investigation or legal proceeding may be instituted, continued or instituted. (b) Any fine, penalty, forfeiture imposed in respect of any contravention of this order may be enforced as if the order had not become final.

“I further direct that this order shall be published in Greater Mumbai by pasting copies of it in conspicuous places of public places, courts, government offices and publicizing it through loudspeakers or megaphones as well as through the media in any available form,” top cop added.
