Badlapur Sexual Assault Case: Will Criminal Action Be Taken Against the Female Police Officer? HC Questions

The parents of the girl victim in the High Court on Wednesday demanded criminal action against the woman officer of the Badlapur police station for refusing to file a case in connection with the sexual abuse of two minor girls in a school in Badlapur. The court also took cognizance of this demand and ordered the state government to clarify what criminal action will be taken against the woman officer.


As a disciplinary action, the female officer has been suspended, and her salary increment has been halted for two years. Besides, the two constables were let off for not taking the matter seriously. In fact, the Special Investigation Team (SIT) set up to probe the case had accused the woman officer and two policemen of dereliction of duty.

After that, a departmental inquiry was conducted against the lady officer and further action was taken. However, this action is not enough and criminal action should also be taken against the concerned woman officer under the Code of Criminal Procedure and the Indian Judiciary Code, advocates Ajikya Gaikwad and Sanket Garud told the court on behalf of the victim's parents. Also, demanded criminal action against the officials concerned. A bench of Justice Revati Dere and Justice Neela Gokhale took cognizance of the parents' demand. Also, additional public prosecutor Prajakta Shinde was ordered to clarify his position in this regard within three weeks.


Three weeks deadline for submission of report

Earlier, in the wake of the Badlapur incident, an expert committee headed by two retired judges was appointed to make recommendations for the safety of school children. However, a demand was also made on behalf of the victim girl's parents that experts related to cyber crimes should not be included in this committee. However, the committee has sought another three weeks' time to submit a report on the recommendations. The court made it clear that the complainants' statements will be taken into consideration after this report is submitted.
