Bandra’s famous restaurant The Junkyard Cafe got into trouble for playing songs without the permission of Novex Communications company who has the copyright of the songs.

What is the news?

Big Fish Ventures Private Limited has a chain of restaurants across the country. Their one such restaurant ‘The Junkyard Cafe’, which is situated in Bandra, is a well-known restaurant amongst people.

Recently, the restaurant played songs of Yash Raj films and Zee Entertainment company. Least they knew that they would get a notice from Novex Communications Pvt Ltd who has the copyright of songs.

Novex Communication company filed a complaint at Bandra Police station against the restaurant for playing the songs without the former's permission. Accordingly, Bandra police registered a case against the restaurant under section 156 (3) of CRPC act and sections 418 and 34 of IPC.

What is IPRS?

The Indian Performing Right Society Limited (IPRS) was formed to issue licenses to users of music and collect royalties from them, for and on behalf of its members i.e. the authors, the composers and the publishers of music and distribute this royalty amongst them after deducting its administrative costs. The IPRS came into existence on 23rd August 1969.

The Central Government granted registration to IPRS on 28th November 2017 and is accordingly now a Copyright Society registered under Section 33 of the Copyright Act, 1957 and Copyright Rules, 2013.

A similar case of copyright took place between composer Ilayaraja and veteran singer SP Balasubramanyam. A few days back, legendary composer Ilayaraja served a notice to the veteran singer SP Balasubramanyam for singing his songs without permission in live concerts.
