Apart from allowing newly admitted transgender students to register their gender, the High Court also decided to allow current transgender students to change the name and gender mentioned earlier in their academic records. The court also ordered the government to issue instructions in this regard to all the educational institutions in the state.
The bench of Justice Gautam Patel and Justice Neela Gokhale, while giving the above order, also mentioned that it takes time to realise one's identity as a man or a woman. Former student of the Tata Institute of Sociology (TISS) had petitioned to change his name and gender in education records. The court gave an order while giving judgement on it.
In 2013, the petitioner had completed her post graduation from the institute as a girl. In 2015, the petitioner assumed another name. He also revealed his identity to a third party. The petitioner now wants to study law and sought an order to the institution to provide fresh educational records with his new name and changed gender. I
What did the court say?
The court cited the orders given by the Supreme Court while passing judgement in this case. Accordingly, it was said that in such cases individuality should be considered inclusively and not compromised by bureaucratic conditions. The case before us is one of being forced to deny self-identity; But it cannot be allowed to impose on a person his particular identity or to compel him to deny his identity, the court also clarified.
