On Thursday, the Maharashtra government decided to curtail the school fees by 15%, despite facing discontent from the opposition. Therefore, on Thursday evening, a Government Resolution (GR) in effect was proclaimed by the education department.

On the same day, the BJP stated that they would undertake a statewide protest in regards to this curtailment of fees, claiming that the authorities are education barons, who won’t let this transpire.

On July 28, Varsha Gaikwad the School Education Minister had announced that the cabinet had decided to reduce private school fees by 15% for the current academic year. The said declaration was undertaken in cognizance of the apex court’s decision to reduce school fees in Rajasthan.

It was only last month that the Supreme court had asked the state government to consider its decision of 15% lower school fees. This was undertaken when a petition was filed by schools against the Bombay High Court order, vacating the stay on the GR preventing the schools from hiking their fees in light of the pandemic.

The state’s school education department was also looking to amend the Maharashtra Educational Institutions (Regulation of Fee) Act, 2011 wherein the government has no right to divulge issues related to the fees of unaided private schools.

Thus reports cite, that the said GR will have no legal backing since it doesn’t have the authority in the said matter.

In the report by Hindustan Times, the GR is stated to have mentioned, “For the academic year 2021-22, all schools should reduce fees by 15%. In cases where fees were already paid by the parents, the excess amount (15% of the total fees) should be adjusted in the coming months of this academic year and if it is not possible then it should be returned to the parents. In case of a dispute over fee reduction, divisional grievance redressal committees can be approached and their decision will stand final. No school management should stop students from attending physical or online classes or appearing for exams in case full or partial fees are pending. The management is also not allowed to hold their exams results.”
