The Maharashtra Real Estate Authority (MahaRERA) has made it mandatory for developers to provide complete details regarding parking in the contract henceforth. MahaRERA has taken this decision after receiving numerous complaints regarding parking.


MahaRERA has received many complaints such as not being able to park the vehicle in the covered, mechanical, garage parking purchased from the developers due to the beams of the building, difficulty in parking the vehicle due to the small parking lot. It has taken a serious note of this and has made it mandatory to attach the addendum containing all the parking details in the allotment letter given at the time of flat registration and in the sale agreements itself so that the home buyers do not face such problems in future.


In this addendum, the number of the place where parking is to be provided, size of parking, height, width, location of parking in the building should be mentioned. MahaRERA has also issued a model draft of this addendum so that there is no error.

Standard Sale Agreement issued by MahaRERA in December 2022 stipulates that acts of God, carpet area, defect liability period and transfer agreement are mandatory in every sale agreement. MahaRERA has announced that even if any changes are made with the consent of the home buyer, it will not be accepted by the former. It has now included parking in these four criteria and henceforth MahaRERA will insist on a prescribed addendum containing complete details of parking. Due to this, MahaRERA has expressed the hope that the house buyers will not have to bear the heartache after moving into a new space due to disputes over parking.


Earlier MahaRERA also issued a circular on July 30, 2021 and issued guidelines regarding parking. It clarifies that since free parking area is not counted in mat area, the developer cannot charge for it. Apart from this, clear guidelines have been given in this circular regarding garage, covered parking. This new circular has been issued to further protect the interests of customers in response to complaints regarding parking.
