Amid the coronavirus crisis, a delegation of leaders from the Maharashtra Vikas Aghadi (MVA) government met Governor Bhagat Singh Koshyari at Raj Bhavan demanding the governor to approve the recommendations made by the state cabinet.

The Maharashtra cabinet recently has asked Governor Koshyari again to nominate Uddhav Thackeray’s as an MLC, or member of the legislative council, from one of the two pending seats from the governor’s quota. 

The delegation comprised of Maharashtra Deputy Chief Minister Ajit Pawar, state Food and Supply Minister Chhagan Bhujbal, state Water Resource Minister Jayant Patil, state Urban Development Minister Eknath Shinde, Industries minister Subhash Desai, Transport Minister Anil Parab and Revenue Minister Balasaheb Thorat.

Earlier, in a meeting chaired by Maharashtra Deputy Chief Minister Ajit Pawar, the state cabinet had recommended Uddhav Thackeray’s name to the Governor who has two vacant seats from his quota. The cabinet had recommended Thackeray’s name to one of the two seats to avoid a constitutional crisis. 

Uddhav Thackeray took oath as Maharashtra Chief Minister on November 28, 2019, and is not the member of either house - legislative assembly or council. According to the Indian constitution, within six months of taking the oath, any minister is supposed to get elected in either state legislative assembly or council. 

The deadline for Maharashtra Chief Minister Uddhav Thackeray to get elected to the state legislature is May 27.

If the Governor fails to act on the recommendations made by the state cabinet, Chief Minister Uddhav Thackeray will have to resign and take the oath again. However, according to article 163 (3) of the Indian constitution, the Governor has to act on the recommendations made by the council of ministers.
