Maharashtra Public Works Department (PWD) Minister Ashok Chavan said that the interim order passed by the Supreme Court not to implement Maratha reservation in the year 2020-21 was “incomprehensible”. 

Supreme Court on Wednesday stayed the implementation of Maratha reservation law which granted quota in jobs and education for candidates belonging to Maratha community in Maharashtra.

Chavan, who heads the cabinet sub-committee, said that the SC’s decision to say the implementation of Maratha reservation was “unexpected, shocking and surprising”. A number of constitutional, legal issues arose in the case and it was referred to another bench, he added.

Although the decision halts admissions under Maratha quota this year, the bench said that admission to post-graduate courses will not be altered and those who have already taken benefit of the Maratha reservation shall not be disturbed. 

Meanwhile, the issue of the validity of 16 per cent reservation for the Maratha community under Socially and Educationally Backward Classes (SEBC) Act of 2018 has been referred to a larger bench. 

Chavan said that the state government will continue to fight until the issue of Maratha reservation is resolved. The Maharashtra government had earlier appointed a cabinet sub-committee to tackle the issue related to Maratha quota.

The minister further informed that the apex court didn’t stay the implementation of the Economically Weaker Section (EWS) while hearing the matter last month. “There are several decisions in which the SC has referred a matter to the larger bench but a different decision was taken only regarding Maratha reservation,” Chavan added. 

The Maharashtra government is planning to file an application with the Chief Justice of India seeking the quashing of the stay order on the implementation of Maratha reservation.
