Maharashtra Public Works Department (PWD) Minister Ashok Chavan on Tuesday said that the Shiv Sena-led Maha Vikas Aghadi (MVA) government under Chief Minister Uddhav Thackeray will defend the reservation quota provided to the Maratha community. 

On Tuesday, Chavan along with Maharashtra Revenue Minister Balasaheb Thorat and state Labour Department Minister Dilip Walse Patil among others were present at the fifth meeting of the cabinet sub-committee on Maratha reservation. Moreover, Vijay Wadettiwar also participated in the meeting via video conferencing. 

The sub-committee headed by Chavan discussed and reviewed its preparations to defend the reservation in the next hearing of the Supreme Court on Maratha reservation. The hearing on the same is on July 7 and the state government has appointed former Attorney General of India Mukul Rohatgi for the case, Chavan informed. 

Supreme Court had earlier refused to stay the Bombay HC order upholding the law providing reservation to Maratha community. However, it decided to examine the constitutional validity of the law. 

On June 27 last year, in its final hearing for all petitions related to Maratha reservation, Bombay High Court upheld the Maharashtra government’s decision to provide reservation to Maratha community in education and government jobs.

However, the HC strikes down the 16 per cent reservation number saying that it is “not justifiable”. Bombay HC asked that the reservation quota for Maratha community should be brought down to 12 per cent in education and 13 per cent in government job appointments.

Later, the Maharashtra government had filed a caveat in Supreme Court of India to ensure that no judgement is passed against the HC's verdict on Maratha reservation without informing the state government. 

On November 30, 2018, the Maharashtra legislative assembly passed the Maratha reservation bill providing 16 per cent reservation to Maratha community in education and government jobs under Socially and Economically Backward Classes (SEBC) category.
