Speaker should decide on petitions against Shinde MLAs by January 10: SC

The Supreme Court has issued an important notice regarding the disqualification of Maharashtra CM Eknath Shinde and his camp MLAs. The Supreme Court has extended time till January 10 for Maharashtra Assembly Speaker Rahul Narvekar to deliver his verdict on the disqualification petitions against MLAs including Chief Minister Eknath Shinde.


The top court said in its order that the final decision on the petitions seeking disqualification of the MLAs of Eknath Shinde's camp and the Chief Minister of Maharashtra himself will have to be taken by the Speaker of Maharashtra. Earlier, the Supreme Court had asked the Speaker of the Maharashtra Assembly till December 31. Had asked for a final decision regarding the disqualification petitions, but Narvekar sought more time to review the pending petitions.

The Supreme Court bench headed by CJI DY Chandrachud remained adamant that the Speaker would have to pronounce the verdict by January 10. The CJI said, “The Speaker has indicated that the proceedings will be closed on December 20 and the Speaker had sought a reasonable extension of time. Keeping in mind the deadline set earlier, we extend time till January 10, 2023 to the Speaker to give a decision.”


The petitions seeking disqualification of Maharashtra Chief Minister Eknath Shinde and his camp's MLAs were filed by Shiv Sena's Uddhav Thackeray faction and NCP's Sharad Pawar faction. The bench on September 18 had directed the Speaker to tell the timetable for the decision on the disqualification petitions against Eknath Shinde and Shiv Sena MLAs loyal to him, who have formed an alliance with the BJP to form the new government in June 2022.
