Uddhav Thackeray vs Eknath Shinde Faction: EC To Soon Decide On Real Shiv Sena Faction

In a major blow to Uddhav Thackeray-led Shiv Sena faction, the Supreme Court (SC) on Tuesday, September 27, has set aside stay on proceedings before the Election Commission of India (ECI) in real Shiv Sena symbol case.

It is pertinent to note that this development came days after the Bombay High Court (HC) on September 23 has allowed the Uddhav Thackeray's Shiv Sena faction to conduct the Dussehra rally at Shivaji Park in Mumbai

With this, the court has given permission to the ECI to decide which faction – Uddhav Thackeray and Eknath Shinde -- is to be recognised as the “real" Shiv Sena party.

The hearing, which went on for more than three-long hours, headed by Justice D Y Chandrachud also comprising Justices MR Shah, Krishna Murari, Hima Kohli and PS Narasimha said: “We direct that there would be no stay of the proceedings before the Election Commission."

The election commission will also take a call on the allotment of the bow and arrow symbol.

Maharashtra Governor Bhagat Singh Koshyari has told the Supreme Court that it’s a political decision to chose which faction is the real one.

Solicitor General Tushar Mehta, appearing for the Governor, also stateed that since it’s a political question it’s the Election Commission of India which should decide the matter.
