Save Aarey: SC A Ray Of Hope For Activists As Bombay HC Dismisses All Petitions Opposing Metro 3 Carshed in Aarey

Environmental activists Zoru Bathena and Stalin Dayanad will now move to the Supreme Court as Bombay HC stated that Aarey cannot be declared as a forest just because of its greenary.

The recent hearing of Bombay High Court (HC) may come as a disappointment to all the environmental activists and enthusiasts working towards the conservation of Aarey. The Bombay HC has dismissed all petitions opposing the Metro 3 (Colaba-Bandra-Seepz) carshed in Aarey and further ruled out that Aarey cannot be considered as a forest.

Activist Zoru Bathena and Stalin Dayanand had filed the petition opposing the felling of 2700 trees for the carshed. Justice Nanadrajog stated that the activists can now move to the Supreme Court (SC). Zoru Bathena stated the following points: 

1. The 15 days period to cut Aarey trees starts only once BMC uploads the tree cutting permission on their website (there are 3 HC orders that states this). 

2. Till date, permission is not uploaded on MCGM website.

3. If any trees are being cut, ask to see a copy of permission on the website as paper permission is not valid. 

4. If any tree is cut 15 days prior to website permission date, they will move HC again

5. Supreme Court is closed for Dassera from October 7-13 and they can file and move SC only on Monday, October 14.

Notably, thousands of citizens, students along with celebrities like Shraddha Kapoor, John Abraham, Katrina Kaif etc had extended their support to the Aarey movement.
