In recent developments, the Bombay High Court has permitted a woman to abort her 23-week-old healthy foetus.

Moreover, the court stated that domestic violence has an effect on an individual's mental health and the same can be a valid ground for medically terminating the woman's pregnancy. According to reports, the judgement was passed by a bench of Justices Ujjal Bhuyan and Madhav Jamdar on August 3 and a copy of it was made available on Tuesday.

The 22-year-old woman happens to be a victim of domestic violence. She had earlier been examined by a panel of experts at the state-run JJ Hospital in Mumbai. In addition, the panel informed that while her foetus was healthy and had no abnormalities, the woman had undergone much mental trauma and the continuation of the pregnancy would add to such trauma.

On the other hand, earlier on August 3, the Bombay High Court had allowed medical termination of pregnancy (MTP) of a 23-week foetus. This development comes at a time when the bench was hearing a plea of a 22-year-old married woman, who said she faced domestic violence and continuing to full term may cause her mental strain.

According to reports, the woman had approached the high court seeking permission for MTP on the grounds that “continuing it will cause grave injury to her mental health’’. Her counsel Aditi Saxena said she had been subjected to domestic violence since her marriage in January 2021.
