The Bombay High Court has issued an immediate halt to the construction of an elevated road on the Santacruz-Chembur Link Road (SCLR) as the site of the private residential building required for the project has not been duly acquired.

‘Kapadia Development Co-op’ near CST flyover at Kurla had complained that work on the elevated road had been started without keeping in view the land owned by the society. A bench of justices Shah Rukh Kathawala and Riaz Chagla passed the order. However, the MMRDA claimed that they had started work on the corridor at Kurla on the understanding that the 700 square meters of land of the society, has been acquired by the Municipal Corporation.

The Municipal Corporation clarified that this was not the case. Therefore, the court ordered the MMRDA to stop work on the project immediately, stating that the work that was being done by the MMRDA was illegal. The court also directed the MMRDA to disclose why it felt that the municipality had acquired the society's premises.

The society has filed a petition in this regard and in April 2019, the society had sent a notice to the corporation and MMRDA that no land of the society should be acquired without going through the legal process. However, taking advantage of the outbreak of the coronavirus, the contractor began work on the corridor at the society's premises at the behest of MMRDA.
