Maharashtra State Housing Minister Jitendra Awhad, on Thursday, March 18, 2021, informed that a tripartite agreement has been made between MHADA, concerned housing societies and developers for redevelopment of buildings in the colony under MHADA. 

Reports state that this decision will allow MHADA to intervene in the process of redevelopment if the developer violates the terms and conditions of the agreement. Besides, this can also provide support to housing organizations or residents.

As of now, MHADA has 56 colonies in Mumbai, and there are other buildings owned by MHADA elsewhere in the state too. The redevelopment of buildings in these colonies is done by the concerned co-operative housing societies by appointing developers at their level, and the land on which they are developed, is owned by MHADA. 

However, after receiving the proposal for redevelopment on such plots from Co-operative Housing Societies and concerned developers, MHADA takes action only for issuance of No Objection Certificate, and had no control over this redevelopment process. This was because it was only a bilateral agreement between the concerned housing society and the developer regarding the redevelopment and earlier MHADA could not intervene in case of violation of its terms and conditions. 

It is said that redevelopment projects of many housing societies in MHADA have been stalled for years, due to which, rent and other grievances of the concerned residents are often not resolved properly. Many such projects are currently stalled in Mumbai and as a result, the residents are stressed and the rent has also stopped too.

Keeping this in mind, as per the provisions of Section 164 (5) of the Maharashtra Housing and Area Development Act, 1976, the body has decided to make tripartite agreement between MHADA, concerned housing societies and developers mandatory. This will also give impetus to redevelopment, said Housing Minister Jitendra Awhad.
