On Monday, January 17, the Bombay High Court dismissed a plea by two BJP councillors who challenged the November 30 Maharashtra government ordinance, notifying the increase of nine seats in the Brihanmumbai Municipal Corporation (BMC), reports stated. 

A division bench was hearing the plea by BJP councillors who challenged the civic body's notification increasing the number of seats in the BMC from 227 to 236 after the same was cleared by Governor Bhagat Singh Koshyari. 

The petitioners stated that the ordinance is based on the 2011 census which are over 10 years old, thus, amending the Maharashtra Municipal Corporation Act is illegal. Adding that the number of councillors was increased without data or contemporary census population data. 

According to reports, to this, the state government responded that it was proportional to the increase in the population. The government remarked that the ordinance was brought into force after adhering to the due legislative process. The government's advocate added that not only was the plea filed on frivolous grounds but it should also be dismissed with costs.

Based on accounts, the bench on Monday asked the petitioners if they wanted a stay in the election to which they responded in the negative. Therefore, the plea was dismissed.
