The apex court handed out a historic decision at it ordered to carry out floor test for Maharashtra government formation on November 27. The decision was given by a three-judge bench comprising of Justices NV Ramana, Ashok Bhushan and Sanjiv Khanna and even directed that the floor test will be conducted through the open ballot and not in secret. The floor test will be telecast live.

Supreme Court of India also directed that floor test by a pro-tem speaker.  There were six names submitted for the post of Protem Speaker to the Governor:

1. Radhakrishna Vikhe-Patil (BJP)

2. Kalidas Kolambkar (BJP)

3. Babanrao Bhikaji Pachpute, (BJP)

4.  Balasaheb Thorat (Congress)

5. KC Padvi (Congress)

6. Dilip Walse Patil (NCP)

There was a demand that Balasaheb Thorat should be made the protem speaker and all three coalition parties Shiv Sena, NCP and Congress were united on this decision. Jayant Patil of NCP was seen saying that says "We have demanded that the senior-most member of the Assembly, who is also called the speaker protect should be made the Protem Speaker. This is the demand of the three parties, that the Governor should consider Bala Saheb Thorat as protem speaker”.

However, in the end, it is BJP's Kalidas Kolambkar has been invited to be the protem speaker. He has taken the oath at the Raj Bhawan in Mumbai and it was administered by Governor Bhagat Singh Koshyari. Post this, he spoke to the news agency ANI and said that, "Tomorrow the first session of new assembly begins. From 8.00 am onwards oath will be administered to the MLAs".

What does a Protem Speaker do?

  • Carry out most functions that a Speaker of the house can and carry out the orders as specified by the court
  • Supervise the activities of the House until the completion of the court’s order is fulfilled.

    He cannot go beyond the defined scope of activity given in the court order.
