According to the latest reports, on Thursday, August 4, the Supreme Court (SC) asked the Election Commission to not take any decision for now on the Maharashtra Chief Minister Eknath Shinde's camp's plea that it be considered the real Shiv Sena and given the party poll symbol.

Based on accounts, a bench headed by Chief Justice N V Ramana mentioned that it would take a decision by Monday, August 8, on referring the matters concerning the recent Maharashtra political saga to a constitution bench. The bench which also entailed justices Krishna Murari and Hima Kohli reportedly mentioned that they will decide whether the matter will be referred to a five-judge constitution bench. 

Narratives suggest that the SC was hearing the petitions filed by the Shiv Sena and its rebel MLAs during the recent Maharashtra political crisis that raised constitutional issues entailing concerning splits, mergers of political parties, defections and disqualifications. 

Earlier, on Wednesday, August 3, the SC had asked the senior advocate appearing for the Shinde camp to redraft the written submissions for more clarity. It had also heard preliminary arguments in the cases concerning the dispute between Shinde and Uddhav Thackeray

The bench has been petitions from both factions in regards to disqualification proceedings, the election of the Speaker, floor test for Shinde government in the Maharashtra assembly, recognition of party whip and proceedings commenced by the Election Commission of India on the request made by the Shinde camp for recognition as the real Shiv Sena as well as its claim over the party symbol
