The crux of their argument lies in disputing Narwekar's claim that the Shiv Sena's constitutional amendment in 2018, which declared Thackeray as the party leader, was not recognized. This, according to Narwekar, led to the split within the party. In retaliation, the Thackeray faction has taken to social media, showcasing documents and photographs that aim to undermine Narwekar's ruling. A report regarding the same was published in the Hindustan Times.

Inconsistencies Highlighted in PM Modi's Recognition

The Thackeray faction brought to light an intriguing inconsistency involving Prime Minister Narendra Modi. In 2019, Modi had officially recognized Thackeray's leadership by submitting a letter of support from him as part of the NDA's formation of the government. This acknowledgment directly contradicts Narwekar's decision, which was based on the Shiv Sena's 1999 constitution. Senior leader Anil Parab from the Thackeray faction emphasized that they had duly informed the Election Commission of India (ECI) about the constitutional changes and Thackeray’s appointment, without receiving any objections from the ECI.

Preparation for Supreme Court Challenge and Internal Speculations

Parab disclosed the faction's plans to take their grievances to the Supreme Court. He questioned the validity of the current judgment, especially considering the BJP and ECI's recognition of Thackeray's authority in 2019. The faction also circulated footage from their executive meeting, where CM Shinde was seen endorsing Thackeray as the leader, to reinforce their claim. Meanwhile, internal discussions within the Thackeray faction have raised questions about possible lapses in communication with the ECI concerning the 2018 amendment of the party's constitution.

Parab, however, dismissed this, accusing the BJP of using the situation to create further political turmoil for their faction.
