Amidst the ongoing tussle between the Governor of Maharashtra, B S Koshyari and the state government, the governor has sent back the state’s ordinance to attain an OBC quota in rural local bodies, post raising some questions, highlighted accounts.

According to reports, Hasan Mushrif the Rural Development Minister, the governor asked that the Supreme Court be informed about the ordinance prior to it being sent to him.

On Wednesday, the state cabinet took the decision to make the submission of an amended ordinance to the Governor. In addition to this, they also issued another ordinance on similar lines for urban local bodies, besides the SCs and STs reservation within the 50% limit.

On Thursday, there is the next hearing of the OBC reservation case in the Supreme Court where it is anticipated that the state will table both the ordinances.

However, ministers from the Maharashtra government have lashed out at the Governor for not signing the ordinance. The BJP, however, has come out in the support of the Governor and have stated that he is acting on the basis of the stance taken by the state’s law and judiciary department on the discussed ordinance.

Back in March, the Supreme Court had quashed the 27% reservation for the OBCs in the state since when combined with the existing reservations, it exceeded the limit. They said the quota will be allowed only after empirical data on the community was collected and the 50% limit wasn’t breached.

In September, however, the state decided to amend the gram panchayat law, permitting OBC quota in the rural bodies, provided it doesn’t cross the limit. The State Election Commission then stated that this wouldn’t have an impact on the upcoming rural body elections since the nominations had already been filed.
