The Bombay High Court slammed Brihanmumbai Municipal Corporation (BMC) for granting permission to rooftop restaurants Mojo's Bistro and 1Above mentioning that the land belonged to Indian Institute of Technology (IIT).

The HC also pointed out that there is no rooftop policy yet the civic body went ahead and gave the permission to run rooftop restaurants.

The high court bench comprising of Justice R M Borde and Justice Rajesh Ketkar who were hearing out the petitions filed by few petitioners which also included a former top cop, Julio Ribeiro.

Are food stalls necessary?

The HC bench expressed its displeasure over food stalls which can be found in every nook and corner of the city, encroaching the space. The bench expressed that there should be a separate controlling body to govern the illegal food stalls but the civic body said that constitutionally it is not possible.

BMC registers FIR against guilty fire department officials

The BMC representative informed the HC that they have taken action against 12 guilty fire department officials who gave the NOC on December 25, 2017, without a proper check up and a fire broke out on December 29, 2017, killing 14 people.

The HC also spoke about handing over the land to restaurants which was meant for IIT. This point was highlighted by the petitioners.

The bench said,

Cancel the permit of those hotels and restaurants who have violates the safety norms. Learn from Kamala Mills fire or else such incidents will continue to occur."

The next hearing will take place on February 14, 2018.
