The Supreme Court (SC) today, July 20, ordered that the status quo on disqualification notices moved by the two Shiv Sena camps -- Uddhav Thackeray faction and Eknath Shinde faction -- against legislators in the opposite side will continue.

The court also mentioned that the issues in petitions may require reference to a 5-judge bench. The apex court also directed the Legislative Assembly secretary to keep all records in safe custody.

CJI NV Ramana said: "Some of the issues, I strongly feel, may require a larger bench. A larger bench can hear the case."

A three-judge bench comprising Chief Justice of India NV Ramana, Krishna Murari and Hima Kohli was hearing six petitions filed by Shinde and Thackeray of Sena in relation to disqualification proceedings, election of Speaker, recognition of party whip and floor test for Shinde government in the Maharashtra Assembly.

Of the six petitions, one is from the Shinde camp and challenges disqualification proceedings initiated by Deputy Assembly Speaker Narhari Zirwal against legislators of the faction when they were in Guwahati.

The five pleas by the Thackeray camp challenge the new Speaker Rahul Narwekar's steps, Governor BS Koshyari's order asking the Thackeray government to prove its majority and a petition seeking suspension of Shinde camp MLAs.

Senior advocate Kapil Sibal for Shiv Sena's Uddhav Thackeray camp tells SC that every elected govt in this country can be toppled if this case can be accepted. Democracy is in danger if state govts can be toppled despite the bar under the 10th schedule.

Meanwhile, senior advocate Harish Salve for Shiv Sena's Eknath Shinde camp seeks time to file a reply on pleas filed by the Thackeray camp and asks to post the hearing next week.

Accordingly, SC posted the next hearing of the six pleas relating to Maharashtra Political Crisis for August 1. With this, it grants time to Maharashtra CM Eknath Shinde-led camp to file an affidavit on the pleas filed by Shiv Sena chief Uddhav Thackeray-led faction.
