Badlapur encounter case: All four reprimanded policemen approach the High Court

Four of the five policemen accused of encountering Badlapur sexual assault case accused Akshay Shinde approached the High Court on Monday. Also, the police demanded the court to provide a copy of the inquiry report of the magistrate who accused them of encountering Shinde. Apart from this, the police have also demanded to hear the statement of the respondent in the petition filed by Shinde's family.


During the hearing of this petition, the court had time and again pointed out the flaws in the investigation by the crime branch. Whereas, a magistrate in Thane had submitted a report on the alleged encounter last month and concluded that the police could have avoided the encounter and handled the situation. Also, the five policemen who were in the vehicle along with Shinde at the time of the incident were held responsible for his death. The court also took cognizance of the report and said that the police are bound to register a case in this case. Also, it was asked by which system the investigation of the matter will be done.

In the background of all this, the matter came up for hearing on Monday. At that time, Thane Crime Branch Senior Police Inspector Sanjay Shinde, Assistant Police Inspector Nilesh More, Constable Abhijit More and Harish Tawde, who were accused of being responsible for the encounter, represented lawyer Sayaji. An intervention petition was filed through Nangre and Pranav Bhadeka. Also, while arguing on behalf of the police, senior advocate Ashok Mundargi told the court that the intervention petition was made for a limited purpose.


Who will investigate the case?

A bench comprising Justice Revati Dere and Justice Neela Gokhale questioned Additional Public Prosecutor Prajakta Shinde on whether the state government has decided to register a case based on the judicial officer's inquiry report and which agency will conduct the investigation.

On this, Shinde demanded time till Monday to convey the decision as the chief public prosecutor was out of the state. The court, however, while adjourning the hearing of the case on Thursday, ordered the government to inform the above decision at that time.
