On Tuesday, March 29, Maharashtra Home Miniter Dilip Walse Patil elaborated on how the state home department has undertaken the decision to withdraw all cases filed under the Indian Penal Code (IPC) 188 during the COVID-19 lockdown against students and citizens, reported news agency ANI.
These cases were filed for the violation of the coronavirus lockdown order. Patil added that once the resolution is approved by the state cabinet, the procedure of withdrawal of cases will commence.

Under the Epidemic Diseases Act, of 1897, those who violated the lockdown orders were punished in accordance with Section 188 of the IPC. An individual is booked under the said section if they are aware of the order being disobeyed owing to which there is likely to be harm.
In violation of the lockdown orders, an individual is either imprisoned for one month or faces a fine of INR 200 or both. Another punitive measure also includes imprisonment for six months or a fine of INR 1,000 or both.
The nature of punishment is in lieu of the offence committed, which are segregated into two types. One is disobedience of an order lawfully promulgated by a public servant, while the other is if the disobedience causes harm to human life, health or safety.
